USERRA Class Action
The Department of Justice has filed its first class action case again American Airlines under USERRA. Allegedly three pilots were denied certain benefits during their military service. For information see this article.
In conversations I have had with human resources professionals and other attorneys, most of them note that the issues arise when employees return and they are not sure what their obligations are. Certainly there is enough information available to make sure this type of suit is not brought against your company.
